Jackson, Mich. (WKHM) — A lawsuit has been filed against Jackson County Medical Care Facility, a nursing home located at 524 Lansing Avenue, in the US District Court for the Eastern District of Michigan.
The Plaintiff, Brandon Weeder, is seeking to bring a class action lawsuit against the nursing home for alleged violations of the Fair Labor Standards Act (FLSA) in relation to its payroll practices involving hourly employees.
According to court documents, Weeder was an hourly nursing home employee from August 2023 – July 2025. The lawsuit alleges that he and other hourly employees were required to review in-service training modules off-the-clock, with employees not being paid for this time. Each module would take around 1 hour to complete according to the lawsuit.
It was also alleged that hourly employees were subject to discipline if they failed to perform the off-the-clock tasks, including not being allowed to clock in to the nursing home’s timekeeping system.
The lawsuit says that the timekeeping system rounded the beginning and end of hourly shifts to the nearest quarter-hour, and that Weeder was instructed to clock-in 7 minutes before his shift was scheduled to begin to review his schedule and plan his upcoming work day.
Weeder alleges that in each work week where he worked 40 hours or more, the rounding policy resulted in an unlawful deprivation of the overtime and straight-time wages required by the FLSA.
The lawsuit claims that the nursing home either knew or should have known that its rounding policies violated the FLSA.
In a response to the lawsuit, Jackson County Medical Care Facility as the Defendant denied any legal wrongdoing, saying that Weeder failed to utilize their process for employees to report uncompensated work time.
The nursing home also argued that Weeder’s claims fail to show an intentional violation of the FLSA on their part.
The response argues that this lawsuit should not be eligible to qualify as a class action, and asks for the case to be dismissed in its entirety.
Weeder is receiving legal representation from Sommers Schwartz, PC, and Jackson County Medical Care Facility is receiving legal representation from Miller Canfield, PLC.
A Case Management and Scheduling Conference has been scheduled for November 20 in front of Judge Laurie J. Michelson via telephone.
